This still very closely resembles the Magento theme - in fact, your register for newsletter graphic contains an image used on the Magento Designer’s Guide. If that’s not stock photography, I’d be careful about using it.
I really like your opening page - I would suggest pulling more of that feel into your actual design.
Also, it would be better if your categories went across the page instead of being piled in the right corner, this way your actual content can be loaded much higher on the page. One other thing that would help is to replace the red and green links from the default Modern template.
