Hi,

I was wondering if it is possible to add a 3% surcharge to customers who choose to use AMEX through magento, as that is how our offline store operates. I couldn’t find a feature to add any sort of surcharge to payment methods so i thought i’d ask to see if there was an option, or any other solution that could get around this problem?

This practice is illegal!  Your store (both on- and off-line) best stop doing this or you can get in trouble as well as lose your charging privileges.

You cannot charge credit card customers more than cash customers.  You have to charge equally across the board, no matter what method of payment the person uses.  So, either do nothing and take the hit on the 3%, stop taking AmEx for payments, or increase your product prices by 3% for every customer no matter what payment they use.

They had a segment on the news about this.

This practice is not illegal in Australia.  In fact payment type surcharge is used by almost every single only retailer over here - online or off.  Its actually illegal for credit card companies to say you can’t do it under Australia consumer law.

This feature is the missing link for Australian retailers.  Varien.  I think its about time you let the retailer make the decision on this one.

It would be a nice feature if there would be a functionalitiy, which allows a function like Payment Type Surcharge with fixed and percent fee type.
For creditcard surcharge it depends on the merchant contract. Mastercard for example allows in Germany a surcharge, Visa does not allow it. 
And in the case of not allowed surcharge, it is not necessary to write in the shop, that it is a surcharge. You can name it handling fee, logistic fee or something else.
And it should be possible, if a customer uses a direct payment solution like money transfer via bank (bank prepayment) it should be possible to grant a discount.

In the US, it is NOT illegal to put a surcharge on credit card orders, but it is against most contracts with merchant account providers.  They can, and will, force you to stop (in the US).

What you can offer is a cash discount.  Stupid, I know, but acceptable.

Well that wasn’t an answer to the Apothix question if its allowed or not. Is it possible or not. No it’ not possible yet .... and this is another lack in Magento ( one of many). I cannot understand why “The Shopping Card” for the future doest have such possibility.
There is some hack around to do it with the price rules and they submitted this as feature reuquest.

This feature is missing for Europe too. Until the year 2004 it was forbidden to charge something for credit card payments. Since about 2005 the dealer is free to charge for creditcard payment. The fee should only not be higher than the real costs the dealer has with cc payments. It is allowed for all payment methods to grant a rebate or surcharge. It is only necessary to inform the customer before the order confirmation and maybe in the payment and shipping conditions that you surcharge something depending on payment method.
There is just one exception: If you only offer credit card payment, you cannot offer a price without surcharge in your shop and later surcharge something on the price. As long as you offer payment methods without surcharge, there is no problem.

Probably Multi Fees extension will work for you http://www.magentocommerce.com/module/2947/multi-fees
It allows you to add a necessary fee to the order when appropriate payment or shipping method is chosen.
